Terms of Service

These Terms of Service ("Terms") govern your use of Remy, a payment reminder service operated by SwiftBill Automation LLC ("we", "us", "our"). By creating an account or using Remy, you agree to these Terms.
1. What Remy Is
Remy is an invoicing and payment reminder tool for freelancers. Remy helps you send professional invoices and automated payment reminders to your clients via email. Remy includes your existing payment links (Venmo, Zelle, CashApp, PayPal) in reminders so clients can pay you directly.
Remy is not a payment processor, bank, or financial institution. Remy does not hold, transfer, or process any funds. All payments happen directly between you and your clients through third-party payment platforms. We are not responsible for the availability, reliability, or terms of those payment platforms.
2. Your Account
You must provide accurate and complete information when creating your account. You are responsible for maintaining the security of your account credentials. You must be at least 18 years old to use Remy.
3. Your Responsibilities
When using Remy, you agree to:
- Provide accurate business information, invoice details, and client contact information.
- Only send invoices and reminders to people who owe you money for services you have provided.
- Obtain appropriate consent from clients before adding their phone numbers for SMS-related features.
- Not use Remy to send unsolicited communications, spam, or harassing messages.
- Comply with all applicable laws and regulations, including CAN-SPAM, TCPA, and any local consumer protection laws.
4. Acceptable Use
You may not use Remy to:
- Send fraudulent invoices or attempt to collect money you are not owed.
- Harass, threaten, or intimidate any person.
- Impersonate another person or business.
- Send invoices or reminders for illegal goods or services.
- Attempt to access other users' data or interfere with the operation of Remy.
- Use automated tools to scrape data, create accounts, or send bulk messages through the platform.
5. Payment and Subscriptions
Remy offers a free trial period. After the trial, continued use requires a paid subscription. Subscription plans and pricing are displayed on our website and may change with notice.
- Trial: New accounts receive a free trial. No credit card is required to start the trial, but one is required for continued access after the trial ends.
- Billing: Subscriptions are billed monthly or annually through Stripe. Your payment method will be charged automatically at the start of each billing period.
- Cancellation: You may cancel your subscription at any time. Your access continues until the end of the current billing period. We do not offer prorated refunds for partial billing periods.
- Price changes: We may change subscription prices with 30 days' notice. Your current rate is locked until the end of your billing period.
6. Stripe Connect
If you connect your Stripe account through Remy (available on the Max plan), your clients can pay invoices by card. Payments flow directly from your client to your connected Stripe account. Remy never holds or processes these funds. Your use of Stripe Connect is subject to Stripe's terms of service.
7. Client Non-Payment
Remy is not responsible for whether your clients pay you. We provide tools to send reminders and make it easy for clients to pay, but we cannot guarantee payment. We are not a collections agency and do not provide debt collection services.
8. Intellectual Property
Remy and its original content, features, and functionality are owned by SwiftBill Automation LLC. You retain ownership of all content you create through Remy, including your invoices, client data, and business information.
9. Limitation of Liability
To the maximum extent permitted by law, SwiftBill Automation LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:
- Your use of or inability to use Remy.
- Any unauthorized access to or use of our servers or your data.
- Any failure of a client to make payment.
- Any errors, bugs, or interruptions in the service.
- Any third-party service outage (Stripe, Resend, Supabase, etc.).
Our total liability for any claim arising from or related to these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.
10. Termination
We reserve the right to suspend or terminate your account at any time if you violate these Terms, engage in abusive behavior, or use Remy for fraudulent purposes. We will attempt to provide reasonable notice before termination, except in cases of severe abuse.
You may delete your account at any time by contacting us. Upon deletion, your data will be removed in accordance with our Privacy Policy.
11. Disclaimer of Warranties
Remy is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the service will be uninterrupted, error-free, or secure at all times.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of the State of Delaware.
13. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on our website. Your continued use of Remy after changes constitutes acceptance of the updated Terms.
